1. Acceptance of Terms

By accessing or using the RobotSpeed platform ("Service") operated by Kleap Technologies SA, a Swiss company ("Company", "we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you do not have permission to access the Service.

2. Service Description

RobotSpeed is an automated SEO content generation and distribution platform that:

• Generates SEO-optimized content using artificial intelligence
• Facilitates automated publishing to various platforms (WordPress, Wix, Kleap, etc.)
• Provides backlink exchange opportunities
• Offers content calendar and planning tools

3. CRITICAL DISCLAIMERS AND LIABILITY LIMITATIONS

3.3 Maximum Liability Cap

Under Swiss law (Code of Obligations Art. 100), our total aggregate liability for any claims arising from or related to these Terms or the Service shall not exceed the total amount paid by you to RobotSpeed in the three (3) months preceding the claim.

3.4 Exclusion of Consequential Damages

In no event shall the Company be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, even if we have been advised of the possibility of such damages.

4. Your Responsibilities

4.1 Content Compliance

You are solely responsible for:

• Ensuring all content complies with applicable laws and regulations
• Reviewing and approving AI-generated content before publication
• Verifying content accuracy, originality, and appropriateness
• Obtaining necessary rights for any images, data, or third-party content
• Compliance with Google's Webmaster Guidelines and quality standards
• Compliance with each platform's terms of service

4.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You must immediately notify us of any unauthorized use or security breach.

4.3 Prohibited Uses

You agree not to:

• Use the Service for any illegal or unauthorized purpose
• Generate content that is defamatory, offensive, or violates any laws
• Attempt to manipulate search engines through black-hat SEO techniques
• Create spam, deceptive, or misleading content
• Resell or redistribute the Service without authorization
• Reverse engineer or attempt to extract our algorithms or source code
• Use the Service to harm competitors or engage in unfair competition

5. Intellectual Property

5.1 Service Ownership

The Service, including its original content, features, and functionality, remains the exclusive property of Kleap Technologies SA and is protected by Swiss and international copyright, trademark, and other intellectual property laws.

5.2 Generated Content Rights

Content generated through our Service for your use becomes your property, subject to:

• Your responsibility for content compliance and accuracy
• Our right to use anonymized data for Service improvement
• Third-party AI model terms and limitations

5.3 License Grant

We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your internal business purposes during your subscription period.

6. Subscription and Payment

6.1 Subscription Terms

Subscriptions are billed monthly at CHF 99 or as otherwise specified. Subscriptions automatically renew unless cancelled before the renewal date.

6.2 Refund Policy

We offer a 14-day money-back guarantee from the initial purchase date. After this period, no refunds are provided for partial months or unused services.

6.3 Price Changes

We reserve the right to modify prices with 30 days' notice. Continued use after price changes constitutes acceptance of new pricing.

7. Data Protection and Privacy

Your use of the Service is also governed by our Privacy Policy, which complies with the Swiss Federal Act on Data Protection (FADP) and GDPR where applicable. Please review our Privacy Policy for details on data collection, processing, and protection.

8. Indemnification

You agree to indemnify, defend, and hold harmless Kleap Technologies SA, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use or misuse of the Service
• Your violation of these Terms
• Your violation of any third-party rights or laws
• Content you create, publish, or distribute through the Service
• Any SEO penalties or platform violations

9. Service Modifications and Termination

9.1 Service Changes

We reserve the right to modify, suspend, or discontinue the Service at any time without liability. We will provide reasonable notice for significant changes.

9.2 Termination

Either party may terminate these Terms at any time. Upon termination, your right to use the Service ceases immediately. Termination does not entitle you to refunds for unused subscription periods beyond the 14-day guarantee.

9.3 Effect of Termination

Upon termination, we may delete your data after 30 days. You should export any necessary data before termination.

10. Force Majeure

Neither party shall be liable for delays or failures in performance resulting from acts beyond their reasonable control, including but not limited to acts of God, government acts, wars, terrorism, strikes, internet service interruptions, or third-party API failures.

11. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of Switzerland, specifically the Swiss Code of Obligations. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Switzerland.

12. Severability

If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be replaced with a valid provision that comes closest to the intent of the original.

13. Entire Agreement

These Terms, together with our Privacy Policy and any other legal notices published by us on the Service, constitute the entire agreement between you and Kleap Technologies SA concerning the Service.
